General Terms and Conditions of Sale – Maison Édèle

Preamble :
The company SARL MAISON EDELE (hereinafter referred to as "Maison Édèle") sells leather goods.

Scope of application:
The general terms and conditions of sale set out below are intended to define the terms of online sales between the brand "Maison Édèle" on the one hand, and any non-commercial natural person of legal age exclusively (hereinafter referred to as "customer") making a purchase on the brand's website on the other hand.
Maison Édèle reserves the right to modify these terms and conditions of sale at any time. All modifications to these terms and conditions will be posted on the website. The terms and conditions of sale in effect at the time the sale is concluded are those binding on the customer.

Price
The prices of our products are those displayed on the website and confirmed to the customer at the time of order completion. They are listed in euros and include all taxes (VAT) for Metropolitan France. These prices include the Value Added Tax (VAT) applicable in France on the date of the order. They do not include delivery charges, which are shown to the customer at the time of ordering.
The transfer of risk of loss and damage to the products will take place after delivery and acceptance of the products by the customer.
We reserve the right to change our prices at any time, however we commit to applying the prices shown on the website at the time of your order.
In the event of a clearly insignificant pricing error, for whatever reason (computer bug, manual error, technical error, etc.), the order, even if validated by Maison Édèle, will be cancelled, and we will inform you of this as soon as possible. You may then, if you wish, place your order again at the correct price.

Ordering items
The photographs and descriptions of the products offered for sale are for illustrative purposes only and are not binding on Maison Édèle. Customers can obtain further information by contacting the company by email: hello@maisonedele.com
In the event of a clear error between the characteristics of the items and their representation, the company Maison Édèle cannot be held liable.
Description of the steps involved in placing an online order
Placing an order by the customer implies their full and unreserved acceptance of these general terms and conditions of sale.
Following the online order, the customer will receive within 24 hours a confirmation email specifying in particular: confirmation of the order, details of the items ordered, the total price, details of delivery costs and the payment method used.

Payment Terms
Customer orders are paid for online by credit card (CB, VISA, Mastercard). Payment is made at the time of ordering.
The customer's bank account is debited on the day Maison Édèle confirms the order. In the event of non-payment, the order will be held until the issue is resolved on the customer's end.
Secure payment
All purchases made on the Site are protected and secure 24/7. By clicking on their chosen credit card, the customer is redirected to the secure Payplug payment site, which uses SSL encryption. During payment, the customer enters their card number, expiry date, and the security code on the back of their card.
This data is automatically transmitted in encrypted mode (SSL protocol) for verification in order to prevent abuse and fraud.

Deliveries:
Items are available for delivery within mainland France (estimated delivery times in working days for shipments within mainland France). For any other delivery requests, please contact us by email: hello@maisonedele.com .
Deliveries are made to the address provided by the buyer at the time of ordering.
Shipping costs are the responsibility of the buyer.
Maison Édèle declines all responsibility for any delays, thefts, losses or damage to the package by La Poste.
Parcels are shipped via La Poste (French Postal Service) using tracked letter, registered letter, or Colissimo registered mail with insurance, depending on the items. The buyer can choose between home delivery with signature confirmation or delivery to a Colissimo pickup point.
The price depends on the weight of the package and is indicated during order confirmation.

Right of withdrawal
The customer has a legal right of withdrawal which he can exercise within 14 days of receiving the goods, under the conditions provided for in Articles L. 221-18 and L. 221-20 of the Consumer Code.
The right of withdrawal cannot be exercised for orders relating to items personalized according to the customer's request and the Products must not have been worn, they must be returned in their original condition and packaging.
To inform the customer of their decision to withdraw, they must contact Maison Édèle at the following email address: hello@maisonedele.com .

Returns
To return an item, the customer must send an email to the following address: hello@maisonedele.com containing the following information: Order number, customer name, delivery address and email address linked to the customer account that was used to place the order.
You can obtain a free return label by requesting it at the address hello@maisonedele.com .
A return label will be sent to you; it must be affixed to the package. The package must be dropped off at a La Poste store or a collection point. Free returns are only available for shipments within Metropolitan France.
The delivery costs for the first shipment remain the responsibility of the customer and will not be refunded.
The customer must return the delivered items in their original packaging and complete (boxes, accessories, protective materials, labels, booklets, etc.). Items returned incomplete, damaged, soiled, or in any other condition that would reasonably suggest they have been used or worn, will not be refunded or exchanged and will be returned to the customer.

Refunds
Refunds for returned item(s) will be processed within 14 days of Maison Édèle receiving the returned items. Refunds are issued via the original payment method.

Product conformity
A product will be deemed non-compliant if there has been an error between the order and the delivered model, between the order and the delivered color, or a quality problem that impacts the very functionality of the product, subject to validation with Customer Service and sending of photos.
Maison Edèle uses natural leathers:

Natural imperfections and variations in the skin are part of the life of leather.

Variations in color shades from one product to another are part of the natural leatherworking process.

Obtaining a natural patina over time, through light, touch, and friction is sought and desired by Maison Édèle.
None of these elements can be considered as non-compliance under any circumstances.

Intellectual property
The "Maison Édèle" brand and, more generally, all Maison Édèle products, their accessories, and their packaging, whether registered or not, are and will remain the exclusive property of Maison Édèle. Any reproduction, in whole or in part, modification, or use of these elements, on any medium whatsoever, without the express prior consent of Maison Édèle, is strictly prohibited.

Disputes
These general terms and conditions of sale are governed by French law.
Any dispute that may arise between the Parties concerning the formation, interpretation and/or performance of this agreement shall, in the absence of an amicable settlement, fall under the exclusive jurisdiction of the Commercial Court of Lyon
